Both State Questions on the ballot in Oklahoma have failed, according to the Associated Press.
State Question 805 would have amended the Oklahoma Constitution to end the use of sentence enhancements based on prior convictions of nonviolent felonies. SQ 805 would have allowed some prisoners currently serving enhanced sentences to motion for a sentence modification.
State Question 814 would have amended the Oklahoma Constitution to change how funds from tobacco settlements are distributed. SQ 814 would have allowed the legislature to reallocate 75% of funds away from TSET and into the Legislative Fund. Currently the Legislature can reallocate 25% of funds away from TSET and into the Legislative Fund, and the Attorney General.
